The bassist for the neo-hippie band Phish is no longer in hot water over an encounter with a 9-year-old girl after a Dead concert at Jones Beach last month.
A judge dismissed child endangerment charges against Mike Gordon, 38, who was busted by park police after the child's mother could not find the girl.
Gordon and the girl, the daughter of a Hells Angels member, were found in an off-limits boathouse in the backstage area during a party after the Aug. 11 show.
WNBC reported Hells Angels who were also at the party found Gordon first and exacted an unspecified punishment before police arrived. Gordon, of Tribeca, told cops he was snapping "art photos" of the girl, the station said.
The judge ruled after prosecutors said they could not prove their case beyond a reasonable doubt, said a spokesman for Nassau County District Attorney Denis Dillon. He said the girl's parents also wanted the charges to be dropped.
